We reserve the right to update these Terms at any time. Continued use of the website means you accept any changes made.

2. Orders & Acceptance

All orders placed through our website are subject to availability and confirmation.

We reserve the right to:

  • Cancel or refuse any order
  • Limit quantities per customer
  • Correct pricing or listing errors
  • Cancel suspicious or fraudulent transactions

If your order is cancelled after payment, a full refund will be issued.

3. Product Information

We do our best to ensure that product descriptions, measurements, and images are accurate.

However:

  • Colours may vary slightly due to screen settings.
  • Fabric prints may appear different in scale depending on the cut.
  • Minor variations in shade between fabric batches may occur.

For fabric and leather purchases, please allow slight measurement tolerance due to cutting.

4. Fabric Cuts & Continuous Yardage

Unless otherwise stated:

  • Fabrics are cut according to the selected unit (Fat Quarter, Half Yard, Yard, etc.).
  • Multiple quantities of the same fabric will be cut in one continuous piece whenever possible.

If you require specific cutting instructions, please contact us before placing your order.

5. Pre-Orders & Backorders

For items marked as Pre-Order or Backorder:

  • Estimated arrival times are approximate.
  • Delays may occur due to supplier, shipping, or customs clearance.
  • We will inform customers if significant delays happen.

Pre-order items may not be cancelled once confirmed with suppliers unless the item is unavailable.

6. Digital Products (PDF Patterns & Downloads)

For digital products:

  • Files are delivered electronically.
  • No physical item will be shipped.
  • All digital sales are final and non-refundable.

Digital patterns are for personal use unless otherwise stated.
You may not redistribute, resell, or share files without permission from the designer.

7. Pricing & Payments

All prices are listed in Malaysian Ringgit (MYR) unless stated otherwise.

We reserve the right to:

  • Change pricing without prior notice
  • Correct errors in pricing

Accepted payment methods are displayed during checkout.

Orders will only be processed once payment is successfully received.

8. Shipping & Delivery

We ship using selected courier partners.

Delivery times:

  • Ready stock: Processed within 2 working days
  • Pre-order items: Based on stated ETA

We are not responsible for delays caused by:

  • Courier services
  • Public holidays
  • Customs clearance
  • Incorrect shipping details provided by customers

Please ensure your shipping information is accurate.

9. Returns & Exchanges

Due to the nature of our products (cut fabrics, craft supplies, and digital downloads), we do not accept returns or exchanges unless:

  • You received the wrong item
  • The item is defective

All claims must be made within 7 days of receiving your parcel.

Cut fabrics cannot be returned for change of mind.

10. Intellectual Property

All content on this website, including:

  • Product photos
  • Descriptions
  • Graphics
  • Logos
  • Website design

Belongs to Shambijoux unless otherwise credited.

You may not copy, reproduce, or distribute our content without written permission.

11. Limitation of Liability

Shambijoux shall not be liable for:

  • Loss of profit or business
  • Sewing mishaps, project failures, or creative disasters (we all have those 😅)

Our liability is limited to the value of the purchased item.

  • Misuse of the website for fraudulent purposes

We reserve the right to restrict access to users who violate these terms.

14. Governing Law

These Terms & Conditions are governed by the laws of Malaysia.

Any disputes shall be resolved under Malaysian jurisdiction.

15. International Orders

We welcome international customers.

Please note:

  • Prices are listed in MYR (Malaysian Ringgit).
  • Currency conversion rates are determined by your payment provider.
  • Import duties, customs taxes, and additional fees (if any) are the responsibility of the customer.
  • Delivery timelines may vary depending on customs processing.

Shambijoux is not responsible for delays, seizures, or additional charges imposed by customs authorities in the destination country.

If a parcel is returned due to refusal to pay duties, incorrect address, or failure to collect, shipping costs are non-refundable.

16. Wholesale Terms

Wholesale purchasing may be available upon approval.

By applying for or purchasing under a wholesale account, you agree:

  • Products are purchased for resale purposes only.
  • Minimum Order Quantities (MOQ) may apply.
  • Wholesale pricing is confidential and must not be publicly disclosed.
  • Wholesale products may not be resold on third-party marketplaces (Shopee, Lazada, etc.) unless explicitly permitted in writing.

Shambijoux reserves the right to:

  • Approve or reject wholesale applications.
  • Revoke wholesale status for violation of terms.
  • Adjust pricing structures with notice.

Payment terms for wholesale orders must be fulfilled before dispatch unless otherwise agreed in writing.

17. Vendor & Marketplace Policy (For Pattern Designers & Contributors)

Shambijoux may host digital products or content created by third-party vendors.

For Vendors:

  • Vendors retain ownership of their intellectual property.
  • Vendors grant Shambijoux a non-exclusive license to market, display, and sell their products on the platform.
  • Vendors are responsible for ensuring their designs do not infringe on third-party intellectual property.
  • Vendors agree to indemnify Shambijoux against claims arising from copyright, trademark, or design infringement.

For Customers purchasing Vendor products:

  • Shambijoux acts as a platform facilitator.
  • Digital files are subject to the individual designer’s license terms.
  • Any disputes related to design ownership or usage rights remain between the customer and designer.

Shambijoux is not liable for the misuse of digital designs by customers.

18. Digital License Agreement (Expanded Clarity)

Unless otherwise stated:

Digital sewing patterns and downloads are licensed, not sold.

You are granted:

  • A non-transferable license
  • For personal use only
  • To create physical handmade items

You may not:

  • Resell, redistribute, or share the digital file
  • Upload the file to public sharing platforms
  • Mass-produce items for commercial resale unless the designer explicitly allows commercial use

Each designer may set additional licensing terms, which must be respected.

19. Data Protection & PDPA Compliance (Malaysia)

Shambijoux complies with the Personal Data Protection Act 2010 (PDPA) of Malaysia.

By using this website, you consent to the collection and processing of personal data, including:

  • Name
  • Contact number
  • Email address
  • Shipping address
  • Payment-related details

Your data is used solely for:

  • Order processing
  • Customer service
  • Marketing communications (if subscribed)
  • Loyalty or rewards programs

We do not sell or rent your personal data to third parties.

You may request access, correction, or removal of your personal data by contacting us.

20. Loyalty Points & Promotional Campaigns

Where applicable:

  • Loyalty points have no cash value.
